These Terms & Conditions outline the agreement between Brentwood Web Design (“we”, “us”, “our”) and the client (“you”, “your”) for web design, hosting, maintenance and related digital services. By working with us, you agree to the following terms.

1. Project Scope & Deliverables

1.1 All work will be carried out as described in the agreed proposal, quotation or project brief.
1.2 Any additional features, pages, integrations or revisions outside the agreed scope may incur additional charges.
1.3 We will provide estimated timelines, but these may change depending on client feedback, content delivery and third?party dependencies.

2. Client Responsibilities

2.1 You agree to provide all required content, images, branding assets and information in a timely manner.
2.2 Delays in providing content may extend project timelines.
2.3 You confirm that all content supplied is owned by you or licensed for use on your website.

3. Payments & Billing

3.1 A deposit (typically 50 percent) is required before work begins unless otherwise agreed.
3.2 The remaining balance is due upon project completion or before the website goes live.
3.3 Hosting, maintenance and subscription services are billed monthly or annually.
3.4 Late payments may result in suspension of services, including hosting and email.
3.5 All fees are non?refundable once work has commenced.

4. Website Hosting

4.1 Hosting is provided and managed by Brentwood Web Design using premium infrastructure.
4.2 We are not responsible for outages or downtime caused by third?party providers, data centres or global network issues.
4.3 Hosting fees must be paid on time to avoid suspension.
4.4 We reserve the right to refuse hosting for websites that pose security risks or violate our acceptable use policy.

5. Website Maintenance & Updates

5.1 Maintenance packages include updates, security checks and general upkeep as described in your plan.
5.2 If you choose not to take a maintenance plan, you are responsible for keeping your website updated and secure.
5.3 Fixing issues caused by client?installed plugins, themes or code may incur additional charges.

6. Revisions & Amendments

6.1 Each project includes a set number of revision rounds as stated in your proposal.
6.2 Additional revisions or redesign requests outside the agreed scope will be billed at our standard hourly rate.

7. Intellectual Property

7.1 Upon full payment, you own the final website design, written content and front?end code created specifically for your project.
7.2 Brentwood Web Design retains ownership of all underlying frameworks, development tools, proprietary code, and processes used to build your website. These elements are licensed to you for use on your website only.
7.3 All stock images, fonts, plugins or third?party assets used within your project remain subject to their original licensing terms.
7.4 A credit link to Brentwood Web Design must remain visible in the website footer for the duration of the website being live, unless a written agreement is made to remove it. This credit acknowledges authorship and forms part of the licensing terms for our design and development work.
7.5 Removal of the credit link without prior written approval may result in additional licensing fees.
7.6 We reserve the right to display completed projects, screenshots and descriptions of your website in our portfolio, marketing materials and case studies unless otherwise agreed in writing.

8. SEO, Performance & Third?Party Services

8.1 We optimise websites using best practices but cannot guarantee specific search engine rankings.
8.2 Third?party tools (e.g., Google, Meta, plugins, APIs) may change or discontinue features without notice.
8.3 We are not responsible for issues caused by third?party updates or service changes.

9. Backups & Security

9.1 We take reasonable measures to secure your website and data.
9.2 No system is completely immune to hacking or data loss.
9.3 Clients are responsible for maintaining secure passwords and user access.
9.4 Backup frequency depends on your hosting or maintenance plan.

10. Cancellations & Termination

10.1 You may cancel hosting or maintenance services with 30 days’ written notice.
10.2 We may terminate services immediately if you breach these terms or engage in unlawful activity.
10.3 If hosting is cancelled, you may request a full site backup for transfer to another provider.

11. Liability

11.1 We are not liable for loss of revenue, data, reputation or business resulting from website downtime, security breaches or third?party failures.
11.2 Our total liability is limited to the amount paid for the service in the previous 12 months.

12. Portfolio Use

12.1 We reserve the right to display completed projects in our portfolio, marketing materials and case studies unless otherwise agreed in writing.

13. Acceptance of Terms

By working with Brentwood Web Design, paying a deposit or approving a project, you confirm acceptance of these Terms & Conditions.
